Assignmenttitle: Improvement of the legislation of the Republic of Kazakhstan, and the knowledge base of the effectivelegislation of the Republic of Kazakhstan

Reference No. (as per Procurement Plan): KZJSISP/ QCBS-04

 The Republic of Kazakhstan has received financing from theWorldBank toward the cost of a Justice Sector Institutional Strengthening Project (JSISP), and intends to use part of the proceedsfor consulting services. The objective of the JSISP is to increase efficiency, transparency and access to state services in thejustice sector.

Consulting services (the "Services") include support forstrengthening the justice sector by strengthening the implementation of key elements of the legal and institutional framework andimproving the service quality and responsiveness of the Ministry of Justicein relation toimprovingthe rulemaking, activities of the justice authorities, and further improving of entrepreneurship legislation to introduceinternational good practices (English law).

The objectives of this Assignment are to assist the Ministry of Justice (MOJ) to meet the JSISP projectresults indicators by (i) increasing transparency and citizens' legal culture, (ii) improving national legislation taking intoaccount international good practices, and (iii) strengthening the knowledge base of the effective legislation.


1)   increasing the citizens' awareness about the rights to participate in the rulemaking process; increasing the citizens' legalculture; obtaining feedback on improving the entrepreneurship legislation from both the legal and business communities (moredetails regarding the categories of respondents will be provided in the terms of reference);

2)   analytical report upon the results of comparative analysis of national legislation and law enforcement practice of RK and international experience and bestpracticesrulemaking, specific laws governing justice authorities, further developmentof the Entrepreneurship Code's provisions, in particular introduction into the legislation of the Republic of Kazakhstan of goodpractices, and knowledge base/commentaries to specific laws/codes;

3)   respective draft laws aimed at the improvement of eacharea and subordinate regulatory legal acts;

4)   apractical commentary to respective effective lawsas well as academic/practical handbooks.

Expected duration of the Assignmentis 12 (twelve) months.

The Ministry of Justice of the Republic of Kazakhstan now invites eligible consulting firms (the "Consultant") to indicate theirinterest in providingthe Services. Consultant should provide information, demonstratingthat they have the required qualifications and relevant experience to perform the Services (brochure, description of relatedassignments, experience in equivalent activities, staff relevant skills etc.).


 The shortlisting criteria are:

1)   at least 5 (five) years' relevant experience inproviding consulting services in law-drafting and writing practicalcommentaries and guidelines onregulations;

2)   excellent reputation for high-quality andtimely delivery or international renown supported by references, recognised ratings or an independentevaluations;

3)   experience of similar assignments in OECDand/or EU member states;

4)   key personnel meeting or exceeding thequalifications, skills and experience indicated in the terms of reference;

5)   knowledge of specifics of the region's and CIScountries' legislation is mandatory.

The attention of interested Consultants is drawn toparagraph 1.9 of theWorld Bank's Guidelines: Selection and Employment ofConsultants under IBRD Loans and IDA Credits& Grants by World Bank Borrowers (January 2011, revised July 2014) ("ConsultantGuidelines"), setting forth the World Bank's policy on conflict of interest.

 Consultants may associate with other firms in the form of a joint venture or a subconsultancy to enhance theirqualifications

A Consultant will be selected in accordance with the Quality- and Cost-Based selection (QCBS) method setout in Consultant Guidelines.
